1. Smugglers Cove is a private recreational community, with a Homeowners Association (HOA) and HOA dues of $300.00 per year. Dues are payable at closing and on a yearly basis.
2. One (1) single family dwelling per lot with a 1600 square foot minimum for a single story house, or a minimum of 2000 square feet total for a two story house, provided that the first floor is a minimum of 1400 square feet.
3. Smugglers Cove has an Architectural Control Committee (ACC). All permanent structures and/or improvements must be submitted to the ACC for approval, and must comply with all federal, state, and local laws and regulations.
4. No breeding of any animal for commercial or recreational purposes is permitted.
5. No further subdivision of any property except to enlarge two or more properties.
6. Horses are permitted on lots having more than 3 acres, provided there is no more than one (1) horse per fenced in acre. The ACC must approve all improvements to lots such as fencing, barns and stables.
7. Docks, bulkheads, walkways, and boat ramps are permitted on waterfront properties. Owner must be in compliance with all local, state, and federal regulations. The lot owner will be responsible for individual permits for work done on waterfront lots.
8. One (1) outbuilding is permitted on each lot but must be built in conformance with the main residence and must be approved by the ACC. Lots having more than 3 acres are permitted a total of two (2) outbuildings.
9. No structure other than a fence may be constructed within ten (10) feet of the property lines.
10. No singlewide or doublewide trailers will be permitted on any lot.
11. Modular Homes are permitted but must be approved by the ACC. All homes must have a minimum roof pitch of 6/12 feet (7/12, 8/12, etc.) and cannot have a title or Vehicle Identification Number (VIN).
